• "Content" means any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links, and other content or material.
• "User Content" means Content that a Customer submits, uploads, or transmits to, through, or in connection with the Services.

3.1 Service Description

Webbfabriken provides various digital infrastructure services, including:

• Web hosting and server management
• Domain registration and management
• Security services (WF SecurityCloud)
• Website development and design
• Technical support and consulting

3.2 Service Level Agreement

We strive to maintain 99.9% uptime for all hosting services. Our Service Level Agreement (SLA) details are available in your service agreement. Key commitments include:

• 99.9% uptime guarantee for hosting services
• 24/7 monitoring and support for critical issues
• Regular security updates and patches
• Automated backups (frequency depends on service tier)

3.3 Service Modifications

We reserve the right to modify or discontinue any Service (or any part thereof) with 30 days' notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.

4. Account Registration

4.1 Account Requirements

To use certain Services, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4.2 Account Eligibility

You must be at least 18 years old and capable of entering into legally binding contracts to use our Services. By registering, you represent and warrant that you meet these requirements.

5. Payment Terms

5.1 Pricing and Payment

• All prices are in the currency specified at the time of purchase
• Prices are subject to change with 30 days' notice
• Payment is due according to the billing cycle selected
• We accept major credit cards, bank transfers, and other specified payment methods

• Pro-rated refunds for annual plans cancelled within terms

6. Acceptable Use Policy

You may not use our Services to:

• Violate any applicable laws or regulations
• Infringe intellectual property rights
• Distribute malware, viruses, or harmful code
• Engage in phishing, spamming, or fraudulent activities
• Host or distribute illegal content
• Attempt to gain unauthorized access to systems
• Interfere with or disrupt service operations
• Resell services without written authorization

6.2 Resource Usage

Fair use policies apply to all services:

• Excessive CPU usage may result in throttling
• Bandwidth limits apply based on service tier
• Storage quotas must be respected
• Email sending limits to prevent spam

6.3 Security Requirements

Customers must:

• Keep all software and scripts updated
• Use secure passwords and authentication
• Report security vulnerabilities promptly
• Cooperate with security investigations

7. Intellectual Property Rights

7.1 Our Intellectual Property

All Webbfabriken intellectual property, including but not limited to:

• Software, code, and applications
• Trademarks, logos, and branding
• Documentation and training materials
• Website content and designs

remains the exclusive property of Webbfabriken. You may not use our intellectual property without express written permission.

7.2 Customer Content

You retain all rights to your User Content. By using our Services, you grant us a limited license to:

• Host, store, and backup your content
• Display your content as necessary to provide Services
• Make incidental copies for technical purposes

7.3 Feedback and Suggestions

Any feedback, suggestions, or ideas you provide about our Services become our property and may be used without compensation or attribution.

8. Warranties and Disclaimers

8.1 Service Warranties

We warrant that our Services will be performed in a professional manner consistent with industry standards. Our specific service warranties include:

• 99.9% uptime for hosting services (as per SLA)
• Security services will function as described
• Support response times as specified in service tier

8.2 Disclaimers

We do not warrant that:

• Services will be uninterrupted or error-free
• Defects will be corrected immediately
• Services will meet all your requirements
• Results obtained will be accurate or reliable

9. Limitation of Liability

Our total liability shall not exceed the greater of:

• The amount paid by you for the Services in the 12 months preceding the claim
• €1,000 (one thousand euros)

These limitations apply regardless of the theory of liability, whether based on contract, tort, negligence, strict liability, or otherwise.

10. Indemnification

You agree to indemnify, defend, and hold harmless Webbfabriken, its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

• Your use of the Services
• Violation of these Terms
• Violation of any rights of another party
• Your User Content
• Your violation of applicable laws

11. Termination

11.1 Termination by You

You may terminate your account at any time by:

• Providing written notice according to your service agreement
• Settling all outstanding payments
• Requesting data export if needed

11.2 Termination by Us

We may terminate or suspend your account immediately if:

• You breach these Terms
• You fail to pay fees when due
• We suspect fraudulent or illegal activity
• Required by law or court order

11.3 Effect of Termination

Upon termination:

• Access to Services will cease immediately
• We may delete your data after 30 days
• You remain liable for all accrued charges
• Provisions that should survive will remain in effect

12. General Provisions

12.1 Governing Law

These Terms are governed by the laws of Sweden, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Stockholm, Sweden.

12.2 Entire Agreement

These Terms constitute the entire agreement between you and Webbfabriken regarding the Services and supersede all prior agreements and understandings.

12.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

12.4 Waiver

No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

12.5 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

12.6 Force Majeure

Neither party shall be liable for delays or failures in performance resulting from acts beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
